Privacy Policy for our Online Learning Plattform (LMS)

Introduction

By using the learning platform, personal data about you is stored. This includes your name and e-mail address, which courses you use and what you did when in these courses. Performance results from the courses (test results, etc.) are also saved.

This data is linked to your person. It is therefore our duty to inform you that this data will be collected and processed and which rights you have in this respect.

We ensure that internally only those persons are granted access to this information who absolutely need this access. Personal data is treated confidentially by us and is not made available to the general public.

Most data is entered by yourself. Therefore you already know this data. Other data is generated automatically by assessments during tests and assignments or by course supervisors/trainers. In addition, logs of your use are automatically generated on the server. These are used to solve technical problems.

Purposes for which the data is to be processed

The learning platform serves to carry out training courses and instructions in the company, to qualify employees and to prove that a training course has been carried out and completed, and to create certificates after successful completion.

Basis for the processing are the basic data protection regulations of the EU, the Federal Data Protection Act, the State Data Protection Act of the State of Baden-Württemberg, legal regulations on safety at work and quality assurance procedures of the company exgenio.

The collected data will be evaluated for the purpose of improving the training. We use the information on course completion for the proof of compulsory training and for the compilation of statistics.

Within the scope of security audits, external parties may have access to the evidence for the implementation of instructions and training courses.

They will not be passed on to third parties outside the European Union. When participating in international comparisons, only statistical data will be passed on.

Duration of storage, deletion

The data in your user profile will be stored until the user profile is deleted. The data from the participation of the course will be stored until the deletion of the course. Results from tests, learning packages and tasks and data at the end of the course and the overall evaluation are stored until the expiry of legal storage obligations.

You have various claims against the responsible body with regard to the data stored about you. These include:

  • Information from the responsible person (see above) about the data stored about you. If you log in to the platform, you can view this data yourself at any time.
  • Right to rectification. If incorrect data is stored, you can adjust it yourself (profile data recorded by yourself) or ask the responsible person to do so. The person responsible will comply with the request, provided that the correction is justified and appropriate.
  • Right to deletion. You have the right to demand that data be deleted that is actually incorrect or for which the person responsible has no further purpose. There is no right to delete data if the person responsible is obliged to retain the data for legal reasons or due to other obligations (e.g. contracts with customers) (proof of instructions, proof of quality assurance, copyright rights of use). The obligation to store data may also exist after termination of the employment relationship. There is also no entitlement to deletion if information has been collected by you yourself and is in the context of information from other users (e.g. forum posts).
  • Right to limitation of processing. The data controller will ensure that, in the event of a restriction, data is only accessible to those persons who absolutely must inspect the data. He may use pseudonymisation and anonymisation for this purpose.
  • Right of objection. You may object to the further use of the data. This can only become effective in the future. The right of objection is not an automatic obligation for the responsible person to delete the data. If the person responsible has storage obligations for other reasons, he will consider this and inform you.
  • Data transferability. You have the right to receive data that you have entered yourself in an electronic format that can be used elsewhere. The right is limited to data which is not subject to a trade secret and therefore may not be transferred to other parties or which affects the rights of others, e.g. copyright.

Right of revocation

You have the right to revoke your consent to the processing of your data. The revocation may result in your no longer being able to access the learning platform and no longer being able to participate in a course. The repayment of fees is regulated in such a case by the terms and conditions. If the processing takes place within the framework of an employment contract, the right of revocation may be restricted.

Right to appeal to supervisory authorities

If you believe that the processing of the data is not lawful, you can contact the responsible person in the company, the data protection officer or the supervisory authority.

Information about profiling

There is no profiling within the meaning of the Basic Data Protection Regulation. Within the framework of courses, tests can be the basis for the proof of the required qualification at the end of a course. Tests are evaluated automatically. The test questions are compiled by people for each individual course.

Further processing for other purposes

It is currently not intended to use the data for purposes other than those mentioned above. If the data is to be used for other purposes in the future, we will inform you in advance.
